Your privacy is important to us, and we are committed to protecting personal data in accordance with all applicable data privacy and security law.  Resolve Guarantee provides its services through the Resolve Guarantee barristers named on this website. In some situations, the individual barrister that you instruct will be the data controller, while in others it will be Procuratio Services Limited, a service company providing administrative services to Resolve Guarantee barristers.  This policy applies in both situations, and it explains how we collect information, for what purpose we use the information about you, the basis on which we collect it and your rights in relation to your personal information.

We provide a service of arranging for Resolve Guarantee barristers to provide advice and other services on a direct access basis to clients.  The information processed by the individual Resolve Guarantee barrister or Procuratio Services Limited is solely for this purpose.

The personal information we collect and hold

We collect personal data from you via our website, emails from you or other correspondence and papers provided to us.  We may also obtain personal data about you from third parties including any connected business or client or other parties to a dispute. The information that we collect is your:

  • Name;
  • Address;
  • Email address(es)
  • Phone number(s)
  • Date of birth;
  • Details of claims/disputes/instructions.

How and why we process personal information

We collect personal data to offer and administer our services.  The personal information that you provide to us will be processed in accordance with that purpose, in particular:-

  • To provide you or a connected business or client (if different) with quotes from a Resolve Guarantee barrister to meet the instructions that you have provided;
  • To provide papers and instructions to the Resolve Guarantee barrister(s) that you (or a connected business or client) decide to instruct;
  • To administer contracts that you (or a connected business or client) may have made with Resolve Guarantee barrister(s) instructed through Resolve Guarantee.

We will use your data in providing our services.  We will share information with Resolve Guarantee barrister(s) who may provide the services to you.  We will generally confirm to  you who the barrister(s) will be.  We may also share information with third parties (such as experts, consultants and other service providers who are performing services on your behalf or for Resolve Guarantee barristers) that we engage where necessary to provide our services. Such third parties have access to personal data for the sole purpose of performing the services specified in the contract made between you and the Resolve Guarantee barrister(s).

We will use your information to carry out our obligations to you (or a connected business or client).  Where we do this, our basis for use is to enable you (or a connected business or client) to enter a contract or, where necessary, for our legitimate business interests.

During and after the period when the Resolve Guarantee barrister is acting for you, the Resolve Guarantee barrister or Procuratio Services Limited may process your personal data for the purpose of dealing with any queries, complaints, claims or litigation arising out of or in connection with the instructions; fee collection; dealing with any dispute about fees; the preparation of accounts and tax returns;  keeping any records that may be required in the event of a tax investigation; compliance with any applicable regulatory obligations; checking for conflicts in connection with any instructions or prospective instructions to the Resolve Guarantee barrister in other cases; and maintaining back-ups of electronic systems to allow for data recovery in the event of accidental deletion or corruption. 

Personal information is processed both manually and electronically in accordance with the above-mentioned purposes and in compliance with current regulations.  We only permit authorised Resolve Guarantee barristers, Procuratio Services Limited, its employees and third-party processors to have access to your information.  These processors are appropriately designated and trained to process data according to the instructions you and we have provided to them.

The Resolve Guarantee barrister may also process your personal data to train other barristers and when providing mini pupillages or other work-shadowing opportunities. Such processing will be necessary for the purposes of the legitimate interest pursued by the Resolve Guarantee barrister in conducting their professional practice.

 

Where we process your data, this is subject to all applicable data privacy and security law, including but not limited to the General Data Protection Regulation (“GDPR”) and the Data Protection Act 2018.  

How long will we hold your personal information

We may retain your personal data, where necessary for the purposes set out above, for up to 16 years after the latest of the following dates:

  • The date on which the last item of work was carried out. 
  • The date on which the last fees due to the Resolve Guarantee barrister are paid or written off.
  • The date on which any proceedings in respect of which the Resolve Guarantee barrister is instructed are finally concluded.
  • The expiry of the time limit for any further appeal in any such proceedings.

At or before the expiry of the 16-year period referred to above, the Resolve Guarantee barrister and/or Procuratio Services Limited will securely destroy any of your personal data that they have retained, unless they determine that it is necessary to continue to retain any of the personal data for any of the purposes described above, in which case a further retention period may be set and the matter reviewed again on or before the expiry of that further period.

The above is subject to the following exceptions:

  • The Resolve Guarantee barrister and/or Procuratio Services Limited may retain records of your name, together with the names of any other parties and a brief description of the nature of the case, for conflict-checking purposes, until the Resolve Guarantee barrister has retired from any form of legal practice or from any judicial appointment.
  • Fee records containing information relevant to the tax affairs of the Resolve Guarantee barrister may be retained for a period of 20 years from the end of the Resolve Guarantee barrister’s accounting year.
  • Personal data contained in records of processing which the Resolve Guarantee barrister and/or Procuratio Services Limited is required by the GDPR to maintain, or which are maintained in order to demonstrate compliance with the GDPR, may be retained for as long as is necessary and at a minimum, for the periods specified in the legislation.
  • Personal data contained in records relating to any complaint will be retained for a period of 6 years from the determination of the complaint or such other period as is specified in the Bar Standards Board Handbook.

We shall take reasonable steps to ensure that your personal data is secure and is not lost, misused, altered or disclosed, otherwise than in accordance with this policy

  

We will remove and/or delete any personal information about you that we do no longer need.  

Your Rights

You have a number of rights in relation to your personal information.  These are: –

  • The right to confirmation whether we are using data about you and to access details about what we are using and how;
  • The right to request that we rectify any inaccurate data, or that we complete any incomplete data that we hold about you;
  • The right to ask us to delete information we hold about you.  We will keep basic data to identify you and retain it solely for preventing further unwanted processing and to comply with our legal obligations or in defending any claim relating to the services that a Resolve Guarantee barrister has provided to you;
  • The right to restrict how we process your data.  This means that we will be permitted to store the data, but not further process it.  We shall retain sufficient data to ensure that we respect your request in the future and, where required, to comply with our legal obligations or  defend any claim relating to the services that a Resolve Guarantee barrister has provided to you;
  • The right to withdraw any consent you have provided for us to use your data at any time;
  • The right to receive the data we hold about you in a format that you can use to transfer the data electronically elsewhere;
  • The right to lodge a complaint with the Information Commissioners Office which can be contacted via the website https://www.ico.org.uk and by telephone on 0303 123 1113.

Full details of these rights, and the circumstances in which they apply and limitations to them, are set out in Articles 15 to 20 of the GDPR.

You also have the following rights under Article 21 of the GDPR:

    • You have the right to object, on grounds relating to your particular situation, to the processing of personal data concerning you based on the legitimate interests pursued by the Resolve Guarantee barrister. If you object to such processing, the Resolve Guarantee barrister will no longer process the personal data except (i) where there are demonstrable compelling legitimate grounds for the processing which override your interests, rights and freedoms or (ii) for the establishment, exercise or defence of legal claims.
    • You have an absolute right to object at any time to the processing of personal data concerning you for direct marketing purposes.

You are not required to provide your personal data under any law, contract or other obligation.  But if you decide not to provide personal data that is relevant to your case, it may become difficult or impossible for a Resolve Guarantee barrister to advise you or to act on your behalf.

Your privacy and data protection is very important to us, and we comply with all aspects of the Data Protection legislation and ensure that any third parties we engage also do so. You can find out more about your rights about your data from the Information Commissioners Office.
